By accessing and using the services provided by Enkoders Software Development Company (“Enkoders,” “we,” or “us”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Service Description
Enkoders provides software development services, including but not limited to custom software solutions, application development, and IT consulting. Our services are offered based on the specifications outlined in individual contracts and proposals.
3. Confidentiality
Enkoders acknowledges the confidential nature of client information and agrees not to disclose, reproduce, or use such information for any purpose other than fulfilling the obligations under the agreed-upon services. Client confidentiality is a priority, and measures are in place to secure and protect sensitive information.
4. Project Timeline and Delivery
Project timelines and delivery schedules will be outlined in individual project proposals. Enkoders will make reasonable efforts to adhere to agreed-upon timelines, and any delays will be communicated promptly to the client.
5. Intellectual Property
All intellectual property developed as part of the services, including but not limited to software code, designs, and documentation, remains the property of Enkoders until full payment is received. Upon receipt of payment, intellectual property rights will be transferred to the client as outlined in the project agreement.
6. Payment Terms
Payment terms and conditions will be outlined in individual project proposals. Clients are required to adhere to the agreed-upon payment schedule. Late payments may incur additional fees and may result in project delays.
7. Changes and Revisions
Changes or revisions to the project scope must be communicated in writing and may result in adjustments to project timelines and costs. Enkoders will provide a revised proposal outlining any changes in scope.
8. Limitation of Liability
Enkoders shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our services.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Pakistan. Any disputes arising from the use of our services will be subject to the exclusive jurisdiction of the courts in Pakistan.
